Terms of Service / End User License Agreement (EULA)

Welcome to Babel Rising Reborn (the “Game”), developed and published by Cosmic Oddity Studio SAS (“we,” “us,” or “our”).

Please read these Terms of Service (“Terms”) carefully before downloading, installing, or playing the Game. By accessing or playing the Game via any authorized platform or store, you agree to be bound by these Terms. If you do not agree to these Terms, do not install or play the Game.

1. Eligibility and Accounts

Age Requirement: You must be at least the minimum age required by applicable law in your jurisdiction to consent to these Terms (or have parent/guardian consent if you are a minor).

Platform Accounts: Access to the Game may require an account provided by the third-party platform or storefront where you acquired or play the Game, and is subject to their respective terms and policies.

Account Responsibility: You are responsible for maintaining the security of your platform account.

2. Limited License

Grant of License: Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and play the Game for your personal, non-commercial entertainment purposes.

Ownership: The Game, including all code, graphics, audio, characters, storyline, titles, and trademarked elements, is owned by Cosmic Oddity Studio SAS or its licensors and is protected by international copyright, trademark, and intellectual property laws. All rights not expressly granted are reserved by us.

Violation of this section may result in temporary or permanent suspension of your access to online features or the Game altogether.

4. Fan Content and Streaming Policy

Gameplay Streaming: We encourage players to stream, record, and create video content (such as Let’s Plays, reviews, and tutorials) featuring the Game on platforms like Twitch, YouTube, TikTok, and other streaming channels.

Monetization: You may monetize your video content containing the Game through standard platform ad revenue and donations, provided that:

Patches and Updates: We may deploy updates, patches, or modifications to the Game from time to time. You acknowledge that updates may alter gameplay balance, features, or technical requirements.

Online Availability: If the Game includes online or multiplayer features, we do not guarantee that these features will be available indefinitely. We reserve the right to discontinue online services with reasonable advance notice.

6. Refunds and Purchases

All financial transactions, purchases, and refund requests regarding the Game or in-game content are processed directly through the authorized platform or store from which you acquired the Game. Refunds are subject to the applicable refund policies of that platform or storefront.

7. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE GAME IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COSMIC ODDITY STUDIO SAS, ITS AFFILIATES, OFFICERS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE GAME.

9. Termination

This agreement remains effective until terminated by you or us.

You may terminate these Terms at any time by uninstalling and deleting all copies of the Game.

We may suspend or terminate your license immediately without notice if you fail to comply with any provision of these Terms.

10. Governing Law and Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law principles.

Dispute Resolution: Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Paris, France, unless applicable consumer protection laws mandate otherwise.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Updated versions will be posted on our website or made available through authorized platforms. Your continued use of the Game following any updates constitutes your acceptance of the revised Terms.
